1. Scope

1.1 These terms apply to contracts for the provision of hotel rooms for accommodation and related services at Maison Marsil. They do not apply to package travel contracts within the meaning of Section 651a of the German Civil Code (BGB).

1.2 Subletting, resale or use of rooms for purposes other than accommodation requires the hotel's prior consent in text form. The right of termination under Section 540(1), sentence 2 BGB is excluded in this respect.

1.3 The customer's own terms and conditions apply only if expressly accepted by the hotel in text form.

1.4 Individually agreed booking conditions, including rates, payment and cancellation terms, take precedence over these general terms.

2. Contract and contracting parties

2.1 The contracting parties are home made GmbH, operating Maison Marsil, and the customer.

2.2 A contract is formed when the hotel accepts the customer's booking or when an online reservation is validly completed.

2.3 For direct bookings through the hotel website, the terms displayed before the final binding booking confirmation apply. The wording of the final booking button must comply with applicable legal requirements.

2.4 For reservations made through Booking.com, Expedia, HRS, Airbnb or other booking platforms, the rate, payment, amendment and cancellation conditions agreed at the time of booking apply. Mandatory statutory rights remain unaffected.

3. Services, prices and payment

3.1 The hotel shall provide the agreed accommodation and services. A specific room is guaranteed only if expressly agreed.

3.2 The customer shall pay the agreed accommodation rate and any additional services used or ordered, including third-party services arranged and paid for by the hotel at the customer's request.

3.3 Prices include applicable taxes and charges unless separately disclosed. Subsequent changes to taxes or charges may be reflected only to the extent permitted by law.

3.4 The hotel may require a reasonable advance payment, deposit or credit card guarantee, as specified in the booking terms.

3.5 Where payment by invoice has been agreed, payment is due within ten days of receipt unless otherwise agreed.

3.6 In cases of payment default or material changes to the agreed services, the hotel may request additional reasonable security within the limits of applicable law.

3.7 The customer may offset undisputed or legally established claims. Mandatory statutory rights remain unaffected.

3.8 Invoices may be sent electronically where legally permitted.

4. Cancellation and no-show

4.1 The cancellation policy agreed for the individual reservation applies. Conditions may vary according to the rate, booking date and booking channel.

4.2 Where free cancellation has been agreed, the customer may exercise that right within the specified period. Cancellation should be made in text form or through the relevant booking channel.

4.3 If no cancellation right exists, an agreed cancellation period has expired and no statutory right of withdrawal or termination applies, the hotel's entitlement to payment is governed by applicable law. Income from re-letting the room and expenses saved must be taken into account.

4.4 Unless another valid arrangement applies, the hotel may calculate its claim for unused accommodation, with or without breakfast, at 90% of the agreed price if the room is not re-let. The customer may demonstrate that no claim or a substantially lower claim has arisen.

4.5 Bookings made through third-party platforms should generally be amended or cancelled using the platform's designated procedure where applicable. Contractual and statutory customer rights remain unaffected.

5. Withdrawal and termination by the hotel

5.1 The hotel may withdraw from a contract where permitted by law or by a valid contractual provision, including where an agreed advance payment remains unpaid after a reasonable additional deadline.

5.2 An important reason for withdrawal or termination may exist where a booking was made using materially false information, the intended stay is unlawful, or circumstances beyond the hotel's responsibility seriously endanger safety or the orderly operation of the hotel.

5.3 Where a valid free-cancellation arrangement or provisional room option exists, the hotel may request a binding decision within a reasonable period if the relevant contractual conditions permit this.

5.4 The consequences of a justified withdrawal are governed by applicable law.

6. Arrival and departure

6.1 Rooms are available from 3:00 pm on the agreed arrival date. Earlier access is subject to availability and prior agreement.

6.2 Reception is normally staffed until 9:00 pm. Guests arriving later may use the hotel's key box by prior arrangement. Access instructions will be provided separately.

6.3 Rooms must be vacated by 11:00 am on the agreed departure date unless a later check-out has been agreed.

6.4 For late departures without agreement, the hotel may charge reasonable compensation for additional use, subject to applicable law. The guest may demonstrate that a lower amount is due.

7. House rules and right to refuse or terminate accommodation

7.1 Guests and visitors must respect other guests, hotel employees and the proper operation of the property.

7.2 Threats, physical violence, serious harassment, property damage or substantial or repeated disruption may justify the exercise of the hotel's house rights.

7.3 Where an important legal reason exists, the hotel may terminate an accommodation contract without notice and require the guest to leave the property. A disagreement or a complaint made in a reasonable manner does not in itself constitute such a reason.

7.4 Mandatory statutory protections and the rights of both parties remain unaffected.

8. Liability and guests' property

8.1 The hotel is liable under applicable law for injury to life, body or health and for damage caused intentionally or through gross negligence.

8.2 Liability for ordinary negligence involving essential contractual duties is governed by applicable law. Any further limitation applies only where legally valid.

8.3 Liability for guests' property brought into the hotel is governed by the applicable statutory provisions, including the special rules on hotelkeepers' liability. Guests should contact the hotel in advance concerning particularly valuable items or special storage requirements.

8.4 Maison Marsil does not operate its own guest parking facility. Information about nearby public parking does not create a parking or safekeeping contract with the hotel.

8.5 Guests are requested to report defects or disruptions promptly so that the hotel can seek to resolve them.

9. Final provisions

9.1 Individually negotiated agreements take precedence. Amendments should be recorded in text form for evidential purposes.

9.2 German law applies, without prejudice to mandatory consumer protection provisions.

9.3 For merchants and legal entities under public law, Cologne shall be the place of jurisdiction to the extent legally permissible. Statutory jurisdiction rules apply to consumers.

9.4 If any provision is invalid, the remaining provisions shall remain effective. Statutory provisions shall apply in place of the invalid provision.

1. Scope

1.1 These terms apply to contracts for the hire of event and meeting spaces at Maison Marsil, including workshops, seminars, meetings, presentations, private celebrations and other events, together with related services.

1.2 Subletting, transferring booked spaces or using them for a materially different purpose requires the hotel's prior consent in text form. This applies in particular to sales events and other activities not covered by the agreed event purpose.

1.3 Individually agreed event offers and confirmed special arrangements take precedence. The customer's own terms apply only where expressly accepted by the hotel in text form.

2. Contract formation and hotel liability

2.1 The contracting parties are home made GmbH, operating Maison Marsil, and the event organiser or customer.

2.2 The contract is formed when the hotel accepts the event booking. Agreed services, event times, participant numbers and prices are specified in the offer or booking confirmation.

2.3 The hotel is liable in accordance with applicable law for injury to life, body or health and for damage caused intentionally or through gross negligence. Liability for ordinary negligence involving essential contractual obligations is governed by statutory law. Other limitations apply only to the extent legally permissible.

2.4 The customer should notify the hotel promptly of defects or service disruptions so that appropriate remedies can be arranged.

3. Services, prices and payment

3.1 The hotel shall provide the expressly agreed services. Additional catering, equipment, services or third-party arrangements are charged as agreed.

3.2 The customer shall pay the agreed charges and the cost of additional services ordered, including third-party expenses incurred by the hotel on the customer's behalf.

3.3 Where a minimum turnover has been validly agreed and is not achieved, the hotel may claim 60% of the shortfall as lost profit. The customer may prove a lower loss and the hotel may prove a higher loss.

3.4 Prices include taxes applicable at the time of contract formation. Changes to taxes or charges may be passed on only as permitted by law.

3.5 Unless otherwise agreed, invoices are payable without deduction within ten days of receipt.

3.6 The hotel may agree reasonable advance payments or security deposits. Additional security may be requested in legally permissible circumstances, including payment default or substantial expansion of the event.

3.7 The customer may offset undisputed or legally established claims. Mandatory statutory rights remain unaffected.

3.8 Invoices may be provided electronically where legally permitted.

4. Cancellation by the customer

4.1 Cancellation conditions expressly agreed in the individual event offer take precedence.

4.2 Free cancellation is possible only where contractually agreed or provided for by law, and must be exercised within the applicable period.

4.3 If no such cancellation right exists or it has expired, the hotel's entitlement to payment is governed by applicable law and the following agreed provisions, insofar as legally effective. Income from alternative bookings and expenses saved must be taken into account.

4.4 For separately agreed room hire charges, the hotel may generally claim 90% of the agreed rental price where the room is not re-let and no greater savings have arisen.

4.5 For agreed food and beverage turnover, the following cancellation charges may apply: 35% from 60 days before the event, 60% from 30 days before the event, and 85% from 10 days before the event. The calculation is based on the specifically agreed catering services and participant numbers.

4.6 Where a conference package price per participant has been expressly agreed, cancellation charges may amount to 60% from 60 days before the event, 75% from 30 days before the event, and 85% from 10 days before the event, multiplied by the agreed participant number.

4.7 For multi-day events, cancellation periods are calculated by reference to the first event day.

4.8 The customer may prove that no loss or a lower claim has arisen. The hotel may prove a higher actual claim where legally permissible.

5. Cancellation or termination by the hotel

5.1 The hotel may withdraw from the contract where permitted by law or by a valid contractual provision, including where an agreed advance payment remains unpaid after a reasonable additional deadline.

5.2 Important reasons may include materially false information about the event, an unlawful event purpose or serious threats to safety or the orderly operation of the hotel.

5.3 For provisional reservations or valid free-cancellation arrangements, the hotel may request a binding decision within a reasonable period where the contract permits.

5.4 The legal consequences of a justified withdrawal, including any claims for compensation, are governed by applicable law and valid contractual provisions.

6. Participant numbers and event times

6.1 An increase in the agreed number of participants by more than 5% must be communicated at least five working days before the event and requires the hotel's approval.

6.2 A reduction of more than 5% should be communicated as early as possible and no later than five working days before the event. For agreed per-person packages, billing may be based on at least 95% of the most recently agreed participant number, where legally valid and taking account of expenses saved.

6.3 If participant numbers decrease by more than 10%, the hotel may propose a suitable alternative room, provided this is reasonable for the customer.

6.4 Changes to agreed starting or finishing times require the hotel's consent. Additional agreed services or extended use may be charged reasonably.

6.5 Maximum room occupancy, fire safety requirements and applicable official regulations must be observed.

7. Food and beverages

7.1 Bringing food or beverages from outside requires the hotel's prior consent in text form.

7.2 Where outside catering or beverages are approved, reasonable, previously agreed charges for service, cleaning, refrigeration or other related expenses may apply.

8. Equipment, technology and permits

8.1 Third-party services arranged by the hotel at the customer's request will be charged according to the agreement.

8.2 The use of external electrical equipment, additional technical installations or alterations to hotel equipment requires prior approval.

8.3 The organiser is responsible for obtaining permits and complying with legal requirements relating to the event within the organiser's area of responsibility.

8.4 The organiser is responsible for obtaining necessary licences and fulfilling reporting or payment obligations for protected music, films and other copyrighted content, including GEMA requirements, unless otherwise agreed.

8.5 The hotel will endeavour to remedy faults affecting agreed equipment promptly. Statutory customer rights remain unaffected.

9. Personal property and decorations

9.1 Exhibits, decorations, equipment and personal belongings brought to the event generally remain the responsibility of the organiser or their owners. Statutory claims against the hotel remain unaffected.

9.2 Decorations and installations must comply with fire safety and other applicable requirements. Fixing items to walls, ceilings or protected historic building features requires prior approval.

9.3 Items must be removed at the agreed time after the event. Reasonable storage or removal costs may apply where agreed or permitted by law.

10. House rules and damage

10.1 The hotel exercises its house rights throughout the premises. In cases of threats, violence, serious harassment, property damage or substantial disruption, the hotel may take legally permissible measures, require individuals to leave or terminate the event where an important legal reason exists.

10.2 A disagreement or a reasonable complaint does not, in itself, justify extraordinary termination.

10.3 Business organisers are liable under applicable law for damage caused by themselves, their employees or persons within their area of responsibility. Consumer liability is likewise governed by applicable law.

10.4 The hotel may agree an appropriate security deposit or guarantee.

11. Accommodation booked with events

11.1 Where accommodation is booked in connection with an event, the hotel's accommodation terms and the individually agreed room booking conditions apply additionally.

11.2 Regular check-in is from 3:00 pm, and check-out is by 11:00 am. Late arrivals may be arranged using the key box.

12. Final provisions

12.1 Individually negotiated agreements take precedence. Amendments should be recorded in text form.

12.2 German law applies, without prejudice to mandatory consumer protection provisions.

12.3 For merchants and legal entities under public law, Cologne shall be the place of jurisdiction where legally permissible. Statutory jurisdiction rules apply to consumers.

12.4 If a provision is invalid, statutory law shall apply in its place, without affecting the remaining provisions.
